INDIA: Dumping duty proposed on NBR from EU, Brazil, Mexico

New Delhi , Oct. 14 The Designated Authority in the Ministry of Commerce and Industry has recommended the imposition of definitive anti-dumping duty on imports of Acrylonitrile Butadiene Rubber (NBR) from the European Union (excluding Germany), Brazil and Mexico. A definitive anti-dumping duty, if imposed by the Finance Ministry, is usually for five years. Any move by the Finance Ministry to impose an anti-dumping duty on NBR from these countries/territories would come as a relief to the sole domestic producer - Apar Industries Ltd, Mumbai. This company had petitioned the Designated Authority for initiating an anti-dumping investigation on NBR imports from these countries. The Authority had initiated the anti-dumping investigation in August 2004. In its final findings, issued recently, the Authority concluded that imports of NBR (excluding powder and carboxylated NBR) from the EU (excluding Germany), Brazil and Mexico had entered the Indian market at less than its "normal value" in those countries/territories. Further, the Authority also said that the domestic industry had suffered "material injury" and that the injury had been caused to the domestic industry by volume and price effect of dumped imports of NBR. Informed sources said that the total imports of NBR increased from 3,213 tonnes in 2000-01 to 6,692 tonnes in 2003-04 (period of investigation). Imports from the EU (excluding Germany), Brazil and Mexico increased from 633.16 tonnes in 2000-01 to 847.06 tonnes in 2001-02, 1708.51 tonnes in 2002-03 and 2343.49 tonnes in 2003-04. In the case of NBR imported from Brazil and produced by Petroflex, Brazil, the Authority has recommended a definitive anti-dumping duty of $195.08 per tonne. For NBR produced by Nitriflex, Brazil, the Authority has recommended a definitive anti-dumping duty of $274.51 per tonne. As regards NBR imported from the EU (excluding Germany), the Authority has recommended a definitive anti-dumping duty of $304.37 per tonne. (Syed Rashid Ali, Karachi, Pakistan)
